Rules for the Purchase and Sale of Items in the bonnets4you.com Online Store
1. General Provisions
1.1. Once the Buyer accepts these Rules for the Purchase and Sale of Items (hereinafter – the “Rules”), i.e. reads the Rules and checks the box next to the statement “I have read and agree with the Rules of bonnets4you.com”), the Rules become a legal document binding upon the Parties, which defines the rights and obligations of the Buyer and the Seller, terms of purchase and payment for items, terms of delivery and returns of items, liability of the Parties and other provisions related to the purchase and sale of items in the bonnets4you.com online store.
1.2. The Seller reserves the right to amend, revise or supplement the Rules at any time, taking into account the statutory requirements. Registered Buyers shall be informed of any amendments, revisions or additions of the Rules after logging in to bonnets4you.com website; to continue shopping in the online store, the Buyer shall be required to accept the modified Rules.
1.3. bonnets4you.com online store carries out its commercial activities in the territory of the Republic of Lithuania and abroad.
1.4. The following persons may shop in our online store:
1.4.1. natural persons with full legal capacity, i.e. persons who reached the age of majority and whose legal capacity has not been limited by courts;
1.4.2. under-age persons from fourteen to sixteen years of age – only with the consent of parents or guardians, except in cases where they independently dispose of their own income;
1.4.3. legal entities;
1.4.4. authorised representatives of the persons referred to above.
1.5. By accepting the Rules, the Buyer confirms that he/she may shop in the bonnets4you.com online store under paragraph 1.4 of the Rules.
1.6. By accepting the Rules, the Buyer agrees that instructions in the Lithuanian language for the item(s) ordered by him/her may, at the Seller’s discretion and where technically possible, be sent only to the email specified by the Buyer as set out in paragraph 2.2 of the Rules, i.e. by sending an active link to the information at the time of preparation of the ordered item(s). It should be noted that, prior to entry into a remote agreement, all the information about the item shall be also made available to the customer in the bonnets4you.com online store next to the item description.
2. Protection of Personal Data
2.1. The Buyer may order items from the bonnets4you.com online store as follows:
2.1.1. by logging in to the online store, i.e. entering his/her login name and password;
2.2. When ordering items in accordance with paragraph 2.1.1 of the Rules, the Buyer shall be required to provide his/her personal data necessary for proper execution of the order in the given data fields, i.e. name, surname, delivery address, phone number and email address; the Buyer may also indicate his/her gender and age.
2.3. If the Buyer consents to the processing of his/her personal data referred to in paragraph 2.2 for the purposes of sale of items and services in the bonnets4you.com online store, analysis of the activities and direct marketing of the Seller, he/she shall be required to check the appropriate box at the time of registration.
2.3.1. By accepting these Rules, the Buyer agrees that his/her personal data referred to in paragraph 2.2 (name, surname, delivery address, phone number and email address) may be disclosed to the Seller’s partners (data processors) who provide item delivery or other services related to proper execution of the Buyer’s order.
2.4. By consenting to the processing of his/her personal data for the purpose of sale of items and services in the Seller’s online store, the Buyer also consents to receiving information notices necessary to execute item orders to the email address and phone number specified by him/her.
2.5. The Seller confirms that the personal data specified by the Buyer shall be processed only for the purpose of sale of items and services in the bonnets4you.com online store and, after obtaining the Buyer’s consent as set out in paragraph 2.3, for the purposes of analysis of the activities and direct marketing of the Seller (except in cases where the Buyer does not permit the processing of his/her personal data for direct marketing purposes as set out in paragraph 2.10 of the Rules). The Seller undertakes not to disclose the Buyer’s personal data to third parties, except the Seller’s partners who provide item delivery or other services related to proper execution of the Buyer’s order. In all other cases, the Buyer personal data may be disclosed to third parties only in accordance with the procedure prescribed by the legislation of the Republic of Lithuania.
2.6. The Buyer as the data subject shall have the following rights:
2.6.1. to receive from the Seller information about the processing of his/her personal data, i.e. have access to his/her personal data and ways of their processing, receive information about the sources of his/her personal data and types of personal data collected, the purposes of their processing, recipients of the data to whom they are disclosed and were disclosed over a period of at least one (1) past year;
2.6.2. to request rectification, erasure of his/her personal data or blocking of the processing (except storage) of such data, where the data are processed in violation of the Law on Legal Protection of Personal Data and other laws;
2.6.3. not to consent to the processing of his/her personal data.
2.7. Pursuant to paragraphs 9.3.3 and 9.4.3 of the Rules, the identity document of the Buyer presented to the Buyer or an employee of Lietuvos paštas and the Buyer’s data contained therein shall be used only for the purpose of proper identification.
2.8. The Buyer who wishes to order partner services offered in the Seller’s online store may do so by expressing his/her consent to the forwarding of his/her personal data to the appropriate partners (recipients of the data) for the purpose of provision of the ordered services.
2.9. To ensure that the Buyer receives complete services in the bonnets4you.com online store, the Seller shall install cookies on the Buyer’s computer (device). The Seller shall use the recorded information to recognise the Buyer as a previous visitor of the bonnets4you.com online store, store the information about items added to the Buyer’s shopping cart and draw up website visitor statistics. The Buyer shall be able to view the information (cookies) installed by the Seller and may delete all or part of the installed cookies. The Buyer may also object to the installation and use of information (cookies) on his/her computer (device); however, in such case, he/she may be unable to access certain functionalities of the bonnets4you.com online store. By accepting the Rules, the Buyer consents to the installation of the information on his/her computer (device). The Buyer may withdraw such consent at any time by changing the settings of his/her browser or contacting the Seller using the contact details provided in the bonnets4you.com online store.
2.10. Any request or instruction regarding the processing of personal data shall be submitted by the Buyer to the Seller by email to gustina@bonnets4you.com or by phone at +37065919369 (using the email address referred to in paragraph 2.2 of the Rules). Having received such a request or instruction from the Buyer, the Seller shall provide the Buyer with a written reply not later than within thirty (30) calendar days.
2.11. Should the Buyer object to the provisions regarding the protection of personal data provided for herein, the Buyer shall lose the right to use the services provided in the bonnets4you.com online store.
3. The Moment of Entry into the Purchase and Sale Agreement
3.1. The Agreement between the Buyer and the Seller shall be deemed concluded from the moment when the Buyer clicks the Pay button (after choosing the desired items and adding them to the shopping cart).
3.2. Each Purchase and Sale Agreement concluded between the Buyer and the Seller shall be registered and stored in the database of the bonnets4you.com online store.
4. Rights of the Buyer
4.1. The Buyer shall have the right to purchase items from the bonnets4you.com online store in accordance with the procedure laid down in these Rules.
4.2. The Buyer shall have the right to withdraw from the Purchase and Sale Agreement concluded with the bonnets4you.com online store by notifying the Seller hereof in writing (by email; the notice shall specify the item to be returned and its order number) at least within fourteen (14) calendar days from the date of delivery/collection of the item.
4.3. The Buyer may exercise the right provided for in paragraph 4.2 of the Rules only if the item has not been damaged or there are no substantial changes in its appearance, and the item has not been used.
5. Obligations of the Buyer
5.1. The Buyer undertakes to pay for the items and accept them in accordance with the procedure laid down in these Rules.
5.2. Registered Buyers undertake not to communicate their login data to third parties. Should the Buyer lose his/her login data, he/she shall be required to immediately inform the Seller hereof using the contact details provided in Contacts section.
5.3. Should any of the details of the registered Buyer provided in the registration form change, he/she shall be required to immediately update the form in My Details section at www.bonnets4you.com.
5.4. When using the bonnets4you.com online store, the Buyer shall comply with these Rules and undertakes not to violate the applicable legislation of the Republic of Lithuania.
